Appeals Ct. Rules CA On Same Sex Marriage Is Unconstitutional!

At long last, equal rights to marry for same sex couples! Opponents of equal rights for LGT have never made a legitimate legal argument as to why the Constitution should not apply to ALL citizens, not just straight ones. What part of "equal protection under the law" in the Bill of Rights don't they get? And what part of "life, liberty and the pursuit of happiness" only applies to straight folks?

A federal appeals court on Tuesday declared California's same-sex marriage ban to be unconstitutional, putting the bitterly contested, voter-approved law on track for likely consideration by the U.S. Supreme Court.

A three-judge panel of the 9th U.S. Circuit Court of Appeals ruled 2-1 that a lower court judge correctly interpreted the U.S. Constitution and Supreme Court precedents when he declared in 2010 that Proposition 8 was a violation of the civil rights of gays and lesbians.

Any responsible reading of the Constitution and the Bill of Rights should forbid the SCOTUS from overturning this decision. The current, radically conservative court has made some of the worst rulings in modern history, but I think even here the case is simply too strong to buck. Fingers crossed.
